Introduction

This purchase is regulated by the following standard terms and conditions for consumer purchases of services over the internet from Norwegian Fjord Explorer. Consumer purchases over the internet are primarily regulated by the Contract Act, Consumer Purchases Act, Marketing Control Act, Right of Withdrawal Act, and E-commerce Act, and these laws provide the consumer with inalienable rights. The terms of this agreement should not be understood as a limitation of the statutory rights but outline the main rights and obligations of the parties for the transaction.

1. The Agreement

The agreement consists of these terms and conditions, information provided in the ordering solution, and any specially agreed terms. In case of any conflict between the information, what is specifically agreed between the parties shall prevail, provided it does not contravene mandatory legislation.

Buyer: The consumer who places an order for fjord experiences or other services.

3. Price

The stated price for the services is the total price that the buyer must pay. This price includes all taxes and additional costs. Any additional costs that the seller has not informed about before the purchase shall not be borne by the buyer. Prices for specific tours and experiences are listed on the website and in the ordering solution.

4. Payment

Norwegian Fjord Explorer requires full payment when booking tours and experiences. Payment can be made by credit card, Vipps, or bank transfer. For group bookings or customized tours, other payment terms may be agreed upon.

5. Delivery

The service is delivered on the agreed date for the tour or experience. Detailed information about the meeting place and time will be sent to the buyer via email after the booking is confirmed.

6. Right of Withdrawal

According to the Right of Withdrawal Act, there is no right of withdrawal for purchases of services related to passenger transport when a delivery date is set. This means that bookings for fjord cruises and other experiences are not covered by a 14-day right of withdrawal.

7. Cancellation and Changes

Cancellations must be made in writing. For cancellations 7-14 days before departure, 50% of the amount will be refunded. For cancellations less than 7 days before departure, no refund will be given. Norwegian Fjord Explorer reserves the right to cancel tours due to insufficient participants or unforeseen events. In such cases, a full refund will be provided.

8. Complaints and Deficiencies

If there is a deficiency in the service, the buyer must notify the seller within a reasonable time after it was discovered or should have been discovered that they wish to claim it. The buyer has always complained in time if it occurs within 2 months from when the deficiency was discovered or should have been discovered.

9. Liability and Insurance

Norwegian Fjord Explorer has liability insurance for all its activities. Participants are nevertheless advised to have their own travel insurance. The company is not responsible for loss or damage to personal belongings during tours.

10. Personal Data

Norwegian Fjord Explorer is responsible for processing personal data provided by the buyer. Personal data is processed in accordance with applicable privacy legislation and our privacy policy available on our website.

11. Force Majeure

Norwegian Fjord Explorer is not responsible for delays or failure to fulfill due to circumstances beyond our control, such as extreme weather conditions, natural disasters, strikes, or other unforeseen events

12. Governing Law and Jurisdiction

These terms and conditions are governed by Norwegian law. Any disputes shall be sought resolved amicably. If this does not succeed, the case may be brought before the ordinary courts with Nord-Troms og Senja District Court as the venue.
